New Delhi: Justice Markandey Katju's allegations have triggered another debate on appointment of judges in the higher judiciary through the collegium system. There is already a Bill drafted by the previous UPA government to bring in changes in current system. It is called the Judicial Appointments Commission (JAC) Bill.
The Bill proposes replacing the apex court collegium with a six-member panel. The proposed panel will be headed by the Chief Justice of India and will have as members two SC judges, the law minister and two eminent citizens.
The selection of eminent citizens through another high-level committee comprising the Prime Minister, Chief Justice of India and Leader of the Opposition in Lok Sabha. Secretary (Justice) in the Law Ministry will be the convener of JAC.
In case of Congress not getting the Leader of the Opposition post in the Lok Sabha, the Bill needs to be tweaked. To fine tune the Bill on other issues, government may call an all party meet at the end of the session before final draft is brought before the Cabinet and consequently before Parliament for consideration and passage.
