Mumbai: Tata Motors on Monday said it will move the Supreme Court against distribution of land which the West Bengal government had taken back from the company through an Act passed in the Assembly.
"As per the country's legal procedures, the company will agitate the matter before the Supreme Court," a late night statement by Tata Motors said.
"The company believes that as per conventions established in the country when a matter is being heard at a court of law, the parties concerned, more so when the party is the State, should not alter the existing state of facts in the matter, and the undue haste being shown by the Government is not conducive to upholding the rule of law," it added.
The Singur Land Rehabilitation and Development Act 2011 charges Tata Motors with non-commissioning of the plant and abandonment, and takes away its rights to the land without providing for a reasonable compensation, despite the company having made a huge investment of over Rs 1,800 crores in the plant, the statement added.
Earlier in the day, the Calcutta High Court refused to pass an interim order restraining the West Bengal government from distributing land to farmers in Singur which it took back from Tata Motors.
Tata Motors counsel Samaraditya Pal had moved an ex-parte petition seeking stay on distribution of land, expressing apprehension that it would be distributed to 'unwilling' farmers within a day or two.
The West Bengal government took possession of 997.97 acres of land at Singur to return to farmers who had 'unwillingly' parted their land - an election promise of the new chief minister Mamata Banerjee.
Tata Motors had acquired the land at Singur to set up its small car Nano project.
Meanwhile, the West Bengal government has already filed a caveat before the Supreme Court so that any petition by Tata Motors over Singur land before it was not heard ex-parte.
