New Delhi: The CPI-M on Friday complained to President A P J Abdul Kalam against the 'unjustified' decision of the Election Commission (EC) to seek details of the office of profit of the party MP’s merely on the basis of allegations by a Trinamool Congress MP.
Party General Secretary Prakash Karat, in a letter to Kalam, said no judicial or quasi-judicial body can seek materials from a party with a view to make out a case of action without disclosing the reason.
"It was incumbent on the EC to reject the purported petition/complaint of Mukul Roy, which did not disclose any prima-facie cognisance of which should be taken and its opinion given to the President," he said.
"Surprisingly instead of rejecting the petition the EC 'gratuitously' gave Roy the opportunity to try and make out a case by inviting him to furnish documents and materials," Karat added.
Karat strongly believed that the EC had exercised unwarranted and unjustified authority because it had violated basic norms of jurisprudence and transgressed all rules of fair play.
"The order passed by the EC is illegal and unconstitutional especially since the EC has chosen to step into the arena of controversy, something that it should have eschewed," he said.
The Election Commission, in such case should reject the complaint "as it was made at a time and with a view to the state elections and was motivated on the face of it for political and not for bonafide purposes," he pointed out.
He was critical of the EC’s decision that sought more details and gave an impression that the poll body "gives credence to the bare allegations that the named MP’s held offices of profit."
"This impression should not have been created by an unbiased constitutional authority," he said.
The general secretary demanded that the complaint be rejected and the EC order recalled immediately to "help restore confidence and meet with the ends of justice."
