Muslim group Jamiat Ulema-e-Hind has opposed the Supreme Court's decision to take up the matter related to divorce rights of Muslim women. Raising a red flag over the apex court hearing the plea challenging divorce rights of Muslim women, Jamiat Ulema-e-Hind has claimed that such matters are related to Muslim personal laws.
The group has also said that previous judgments of the apex court have provided adequate protection to Muslim women.
Earlier, the SC had noted, "It was pointed out that inspite of guarantee of the Constitution, Muslim women are subjected to discrimination. There is no safeguard against arbitrary divorce and second marriage by her husband during currency of the first marriage, resulting in denial of dignity and security to her."
Recently, the Bombay High Court had held that the mere existence of a document like talaqnama, is not sufficient to render a valid Talaq. Justice MS Sonak had observed that for a valid Talaq, it is not sufficient that the prescribed expressions are pronounced thrice but the stages it is preceded by, are required to be pleaded and proved before the Court, if disputed by wife.
