KOCHI: The High Court on Tuesday came down heavily on Italy while dismissing the two marines’ petition seeking to quash the FIR against them in the Enrica Lexie case. The court observed that the Republic of Italy has come to the court without any bona fides. ‘’No probe was initiated by Italy to prosecute the marines,” the court said and added that the FIR cannot be quashed and the marines are liable to be prosecuted for murdering the two Indians.It said the marines cannot claim sovereignty and ‘Enrica Lexie’ was not an Italian government-owned vessel, but a private ship. Criticising the victims’ family members, the HC said that they wasted the court’s valuable time. The court avoided imposing heavy costs in view of the losses suffered by the family. However, Doramma, wife of Valentine, one of the victims, and the sisters of Ajeesh Pink, the other victim, should pay `10,000 each to the State Legal Aid Fund, the court held.
