If the state government cannot perform its administration, the court may have to interfere and take up the duty of administration, warned High Court on Wednesday while hearing the case of a sub-register who was transferred paving way for the in-charge sub register A Division Bench headed by Justice N Kumar told the government counsel, “Inform your government to transfer official under Karnataka civil service rule section 32 and it cannot transfer the official as it wishes and it cannot be tolerated.
If the state government cannot perform its administration then inform the court and it will interfere and may take up the duty of administration and it will give a very good administration and show you,” Justice Kumar remarked.
The state government has appointed Bojaraja as an Incharge to Gowribidanoor Sub-register office.
Then the state government transferred Hobalaih and appointed Bojaraja to Vijayanagara Sub-register office challenging the government order.
Meanwhile, Hobalaiah filed a petition before KAT but it had dismissed his petition.
Then he filed an appeal before the High Court.
