Mumbai: The Bombay High Court on Tuesday stayed for a week the framing of charges against actor Shiney Ahuja, accused of raping his maid, after the prosecution sought time to file reply to a petition seeking copies of medical and forensic reports.
A fast track court in Sewri was expected to frame charges against Shiney on Wednesday.
Justice S A Bobade stayed the framing of charges for a week after the prosecution sought time to file reply to the petition filed by the actor.
Shiney's lawyer had approached the High Court seeking copies of medical and forensic reports of the actor and the victim, claiming the DNA reports of the two did not match.
The sessions court had earlier rejected the application of Shiney's lawyer observing that the defence lawyer did not require the documents to argue on the framing of charges.
"Ahuja, who was released on bail from the High Court last week, will still appear before the sessions court on Wednesday," Shrikant Shivade (Shiney's lawyer) told PTI.
36-year-old Shiney was arrested on June 15 after his maid lodged a complaint with Oshivara police station that the actor had raped her at his residence. The wife and child of the actor were not at home when the alleged incident occurred.
Police had on August 13 filed a 109-page chargesheet against the actor accusing him of rape, wrongful confinement and intimidation. The chargesheet consisted of medical reports which indicated Shiney had sexual intercourse with his maid.
