Gulburg riot victims seek stay on trial, move HC
Sixty-nine persons, including former MP Ehsan Jaffery, were killed at Gulberg violence during the post-Godhra riots.

Ahmedabad: Some of the victims of 2002 Gulburg Society massacre have approached the Gujarat High Court, seeking a stay to the trial in the case till the Special Investigation Team (SIT) probing the case submits final report before the trial court.

Petitioners Rupa Dara Mody and others have challenged the November 18 order of the trial court rejecting their plea for stay and further investigation.

Justice JC Upadhyay, who heard the arguments partly on Wednesday, has posted the next hearing for December 28.

The petitioners have also sought further investigation. They contend that unless all the evidence collected by the SIT is submitted in the court, the trial would suffer.

Petition further stated that the SIT had probed complaint of Zakia Jaffery, the widow of slain former Congress MP Ehsan Jaffery, on the Supreme Court's direction, which also touched on aspects relevant to Gulburg case.

It also demanded that those findings be placed before the trial court.

Till the SIT places its final report, as directed by the Supreme Court, before a magisterial court, and copy is placed with the trial court, the trial should not go on, the petitioners contended.
