New Delhi: In a major relief for Delihi traders and residents, the Supreme Court on Wednesday permitted desealing of commercial establishments and shops as per the January 30, 2008 notification of the Central Government.
The court, however, put a rider that individuals whose shops will be desealed will have to file an undertaking that they will abide by the final orders of the court on the issue of legality of the Centre's January 30 notification. The court has adjourned the matter till July 7.
The Central Government notification had permitted the civic authorities to deseal the premises which were sealed in accordance with the Apex court's earlier order.
While passing the interim order, a Bench headed by Justice Arijit Pasayat said in cases where the MCD has desealed the premises, owners have to give an undertaking within 10 days.
Civic body officials said the MCD was in the process of identifying properties which could avail the benefit from the Central Government's directive for desealing structures that were built prior to December, 2006. The paper works are on and the formalities are being completed, the officials added.
Earlier this week, the MCD had invited applications to avail of the scheme which provides relief under special laws. The civic body is requesting affected people to submit an application to the Zonal Deputy Commissioner concerned for desealing their properties, which were once sealed on charges of misusing residential premises for commercial purposes.
The notice comes 10 days after the Union Urban Development Ministry asked the local authorities to deseal premises protected under the Delhi Laws Special Provisions Act of 2007. The Ministry also asked them to suspend action against structures that came up before December 31, 2005.
