THIRUVANANTHAPURAM: The PSC sitting held on Monday revoked Chairman K S Radhakrishnan’s order extending the validity of all the 893 rank lists which would have expired on April 30, 2012 citing that the Chairman had no powers to extend the validity on his own and his decision was arbitrary in nature and would set a bad precedent. However, later, the full Commission sitting extended the validity of all the lists up to March 31, 2013. Radhakrishnan wrote a dissenting note to uphold his powers to take such a decision in unavoidable circumstances. It was on Saturday that the Chairman extended the validity of rank lists for one year. But the PSC full commission sitting noted that the Chairman had no authority to do so. However, the Chairman stuck to his firm stand that under Rule 36 of the Commission, the Chairman or, in his absence, a person entrusted with the powers of the Chairman could take such actions and need only to get it ratified in the Commission’s sitting as early as possible. Following this, the Commission revoked the Chairman’s order and took the decision collectively to extend the validity of all those lists to March 31, 2013. But those lists which would cross four-and-a-half years period in the meantime would not be extended further. In case of publication of new lists for the post, the old lists will automatically get expired. The new decision of the Commission would benefit the candidates by giving them chance for appointment for a further period of maximum 11 months. Speaking to ‘Express,’ Chairman Radhakrishnan said that he was acting on the basis of the provisions of Rule 36 of the Commission and there was nothing unnatural and arbitrary in it. He, however, said everybody knows the thinking behind the full Commission’s action. ‘’Chairman on one side and 17 members of the Commission on the other side. Everybody knows the thinking behind it,’’ he said. It may be noted that all the members of the Commission were appointed during the LDF Government’s tenure.Backlogs to be FilledThe PSC has also decided to fill all the backlogs in the vacancies for physically challenged persons. A notification in this regard was also issued with effect from Monday.
