New Delhi: As the Left and the Congress fight a tug-of-war over nuclear deal, the Supreme Court on Monday dismissed a petition by an IITian seeking Parliament's approval of the Indo-US agreement before going ahead with the same.
The court said it was a policy matter not to be examined by it. "This is not the matter to be examined by this court," a Bench headed by Chief Justice KG Balakrishnan said as it refused to consider the plea.
The petitioner had contended that the content of the agreements was detrimental to the security of the country and the decision to go ahead with the deal was taken by a handful of executives, who cannot claim supremacy over Parliament.
The SC order came at a time when the Left has been telling the UPA Government not to go ahead with the deal until it is scrutinised on the floor of Parliament.
"It is a matter of policy and we do not interfere in it," the SC Bench, also comprising Justices RV Raveendran and VS Sirpurkar, said during a brief hearing.
Mumbai-based IITian MN Ramamurthy, who made frantic effort by both scientific and legal arguments, to get a direction to the Centre, wanted to know the reasons from the Bench why his petition was dismissed.
"We do not give reasons. It is the discretion of the court to entertain a petition," the Bench said.
Ramamurthy had commenced his arguments by stating that the core issue over the 123 nuclear deal was still valid and even many of the legislators were in disagreement to it.
However, at this point the Bench said that his main prayer in the petition questioning the nuclear deal did not survive. The petitioner also pointed out that it was not yet over as the deal has not been signed and the process has only been initiated.
