The CBI special court at Ghaziabad in Uttar Pradesh will deliver the judgement in the sensational Aarushi-Hemraj twin murder case on Monday. With this verdict, the mystery behind the five-and-a-half-year old double murder case is likely to come to an end and bury the numerous conspiracy theories rumoured to be behind the grisly crime. Ghaziabad CBI special court judge Shyam Lal will read out the verdict in the presence of accused and the investigating agency.
The CBI has charged Aarushi's dentist parents Rajesh and Nupur Talwar with the murder of their teenage daughter and domestic help Hemraj in May 2008. In their defence the parents have accused the CBI of framing them in the case.
The case which has all the twists and turns of a crime novel or a cinema is one of the most widely covered real life crime incidents in India.
The sensational killings of Aarushi and Hemraj were not just a murder mystery; it was a case which saw a protracted legal battle between the accused and the prosecution. From the trial courts right up to the Supreme Court several orders were challenged, procedure questioned with the apex court finally warning defence counsels not to indulge in frivolous litigation.
As Aarushi-Hemraj murder accused Dr Rajesh Talwar walked out of the Dasna Jail on July 13, 2008 after the CBI failed to file a charge sheet against him, he would have little inkling of what was to follow. Two years later in 2010, the CBI filed a closure report in the court saying they cannot establish who killed Aarushi and Hemraj only for the court to turn it into a charge sheet and order a trial. It was the beginning of a complicated legal battle.
Dr Rajesh Talwar, on December 29, 2010 said, "I have not got justice for my daughter despite doing everything."
First the closure report itself was challenged on the grounds that scientific evidence against compounder Krishna and his friends Rajkumar and Vijay Mondal was ignored and that attempts be made to recover more DNA samples from the crime scene.
Rajesh Talwar said, "The first team of CBI has done some work and something, I want to know why that was not taken into account." On February 9, 2011, the court rejected their demand and instead ordered a trial against Rajesh and Nupur Talwar - the husband and wife were now accused of murdering their own daughter Aarushi and domestic help Hemraj.
Nupur Talwar had said, "A fair scientific investigation is what we want."
The Talwars then first petitioned the Allahabad High Court for a stay on proceedings which were rejected. They went to the Supreme Court which rejected them as well. The defence then moved the court to get the trial shifted out of Ghaziabad - this plea too was rejected. Repeated summons were issued against the Talwars but they failed to appear in the court. Finally the Ghaziabad court issued warrants against them.
While Rajesh was granted bail there was a non-bailable warrant against Nupur. She went underground and the CBI started hunting for her at various locations in Delhi and NCR. Her lawyers once again rushed to the Supreme Court seeking protection from arrest. The court asked the CBI not to arrest her till her appeal was disposed off.
On April 27, 2011, the Supreme Court rejected her appeal and asked her to surrender before the trial court. On April 30, 2011, Nupur was arrested and sent to Dasna jail.
Another petition was filed in the Supreme Court asking for a review of its earlier order and quashing proceedings in the trial court. This too was rejected with a stinging observation by the apex court. "I have noticed that every single order passed by the magistrate, having any repercussion, is being assailed right up to this court. Of course, the right to avail a remedy under law is the right of every citizen. But such a right cannot extend to misuse of jurisdiction."
By now the Talwars had no choice but to face trial which formally started in February 2011. Two years and nine months later it's now judgment day on November 25.####
