The Crime Branch on Monday submitted before the Kerala High Court that the two CBI officials whose names were mentioned in CBI ASP Haridath’s suicide note have not been arraigned as accused in the case.

The CB made the submissions on the anticipatory bail pleas of the officials - Unnikrishnan and Rajan. Justice Bhavadasan asked the Crime Branch, “Are they accused now?” to which the Crime Branch said that investigation into the case is progressing and that they are not yet arraigned as accused.

Appearing for the state, Additional Director General of Prosecution KI Abdul Rasheed argued that prima facie evidence suggests the complicity of the two officers.

But they have not been implicated in the case since the forensic lab reports on the laptop and hard-disks seized from the cops have not yet been received.

There was evidence, including the deposition of witness against the two officials. Counsel for the petitioners Pirappancode V S Sudheer submitted that the whole issue was part of the efforts of the superior officers of the CBI to exonerate the two top IPS officers from the Sampath custodial death case.

The higher-ups were targeting the petitioners though two other names were also mentioned in the suicide note of Haridath who was the investigating officer of the Sampath case.
